Most people intend to get an estate plan in place. They just have not done it yet.

Tony Hsieh had not either. The founder of Zappos died in 2020 at 46, leaving an estate worth hundreds of millions and no instructions about what to do with any of it. What followed was years of public court proceedings and contested claims that his family had to work through while grieving.

None of it had to happen that way.

Dying without a plan does not mean nothing happens

It means the state decides what happens.

A court process called probate begins, and it is public record. Creditors and claimants line up. Family members who expected clarity get conflict instead. And everything you spent a lifetime building sits frozen while it gets sorted out.

What a plan actually changes

When your documents are in place and your assets are titled correctly, your family does not go to court.

Someone you chose steps in, follows your instructions, and handles it privately. No waiting. No public record. No argument about what you would have wanted, because you already said.

The documents alone are not enough

This is the part most people miss.

A trust that exists but was never funded. A will that was never updated after a divorce or a new business. These create almost as many problems as having nothing at all, and they are more dangerous because they feel like protection.

A real plan means three things are true at once. Your assets are titled to flow into your trust. Your beneficiary designations are current. And the people you trust know what to do and where to find everything.

Tony Hsieh understood systems and risk better than most people ever will. He just never sat down with someone and made it real.
